Dispute Resolution Policy
Establishes the terms and procedures for resolving disputes on the Uhpenry platform, including project takedowns, content reports, and account enforcement.
This Dispute Resolution Policy (“Policy”) sets forth the framework by which disputes between users of the Uhpenry platform (“Platform”), and between users and Uhpenry, shall be addressed.
By using the Platform, you agree to be bound by this Policy in conjunction with our Terms of Service, Refund Policy, and any other applicable Uhpenry policies.
1. Definitions
For purposes of this Policy:
- “Booth” means any account or entity that lists, sells, or distributes projects via the Platform.
- “User” means any account or entity that purchases or accesses projects via the Platform.
- “Dispute” means any disagreement between two or more parties concerning content, transactions, account enforcement, or any other action taken under Platform rules.
- “Enforcement Action” means any moderation measure taken by Uhpenry, including but not limited to project removal, account warnings, suspensions, or restrictions.
2. Disputable Actions
2.1 The following may be disputed under this Policy:
- Project or listing removals, including DMCA-related takedowns.
- Reported content or conduct that results in moderation.
- Account warnings, suspensions, or other restrictions.
- Marketplace listing violations.
- Other enforcement actions that materially affect a user's rights or privileges on the Platform.
3. Action-First Enforcement
3.1 Uhpenry operates under an action-first enforcement model to limit potential harm from infringing, unlawful, or harmful content.
3.2 In practice, this means:
- Reported or flagged content may be immediately removed from public view (“Temporary Removal”) from 4 hours of being reported.
- Both the Booth and the reporting party will be notified of the action taken.
- The affected party may initiate a dispute pursuant to Section 4 of this Policy.
4. Internal Dispute Resolution Process
4.1 Initiation, A Dispute must be filed against the report via the Platform's designated dispute submission process within twenty-four (4) hours.
4.2 Exchanges, Both parties shall have the opportunity to chat and try to resolve the issue by exchanging statements, evidence, and clarifications through the Platform's chat interface.
4.3 Resolution Window, The parties are encouraged to reach resolution within Five (5) calendar days of initiation.
4.4 Restoration, If the parties mutually resolve the matter, Uhpenry will review for compliance and, if applicable, restore the project or reverse the enforcement action.
4.5 Disputes resolved internally without escalation shall not impact account standing or reputation scores.
5. Escalation to Uhpenry Moderation
5.1 If either party fails to respond, acts in bad faith, or no resolution is achieved within the prescribed timeframe, the dispute may be escalated to Uhpenry's Moderation Team.
5.2 Upon escalation, Uhpenry will:

Conduct an independent review of the matter.

Render a determination, which may include upholding or reversing the enforcement action.

Impose additional measures, including permanent removal of content, account suspension, or formal warnings.
5.3 Escalated disputes may affect the account standing of any party found in breach of Platform rules.
6. Platform-Initiated Reviews
6.1 Uhpenry reserves the right to proactively audit and review projects and listings.
6.2 Where violations are detected, Uhpenry may:
- Immediately remove or restrict access to the content.
- Notify the Booth of the reason and provide an opportunity for correction.
- Permit the Booth to dispute the finding pursuant to this Policy.
7. Good Faith Requirement
7.1 All parties must participate in the dispute process in good faith.
7.2 Abuse of the dispute process, including but not limited to false reports, frivolous claims, or manipulation of the process, may result in penalties, including account suspension or restriction.
